Terms & Conditions

Effective Date: 23 June 2025

 

Assumptions and Exclusions      
 

PAC Planning Pty Ltd ABN 24 687 224 540  trading as PAC Planning (referred to in these terms as “PAC Planning”, “PAC” “we”, “us”, and “our”).

  • The proposed fee quote is valid for a 12 month period from the date of issue.

  • Current projections are based on the information provided by the client. Should further additions or amendments which have not been outlined in the original scope of works be requested, additional fees will apply. 

  • The client accepts that fees will be payable to engage third party services, such as consultant reports and plans, in addition to the fees paid for PAC Planning services, as outlined in this Agreement. 

  • The client accepts that fees will be payable to Council for the Development Application, in addition to the fees paid for PAC Planning services, as outlined in this Agreement.

  • The client accepts that fees will be payable to the relevant Principal Certifying Authority (PCA) in addition to the fees paid for PAC Planning services, as outlined in this Agreement.

  • PAC Planning will not be responsible for the quality or accuracy of any work undertaken by third parties. 

  • PAC Planning cannot provide confirmation that Council will approve any development application, and each application is subject to individual merit-based assessment.

  • PAC Planning will endeavour to provide planning services in a timely manner, as outlined in Part 2, but the client acknowledges that any timeframe provided by PAC Planning are estimates only due to the limited control over the planning process and third-party input. 


    Timeframe for Services    

     

  • If the Service Agreement is agreed to by both parties, PAC Planning will issue an invoice for payment of services to the applicant.  

  • Following receipt of payment in full and completion of applicable forms, the required site documentation, PAC Planning will commence the services as outlined in the Service Agreement.

  • PAC Planning cannot provide an estimated timeframe of how long Council assessment and determination may take. 

  • All works are subject to workload capacity. Should these timeframes vary at the time acceptance is received, you will be notified by the Principal Town Planner. Please note that this is based off working days only and doesn’t include public holidays, periods of closure around Christmas and New Years’ and any other unforeseeable event.


    Prices and Payment

     

  • All prices are in Australian Dollars (AUD) and are exclusive of any Australian Goods and Services Tax (GST) (as applicable).

  • Payment must be received in full for services to commence.           



    Cancellations
     

  • You are free to cancel the Services and this Agreement without notice at any time before PAC Planning has begun providing them for each individual job. If you have made any payment to PAC Planning for any Services we have not yet provided, these sums will be refunded to you as soon as reasonably possible, and in any event within 14 calendar days of Our acceptance of Your cancellation.

  • Once PAC Planning have begun providing the Services, You are free to cancel the Services and this Agreement at any time by giving Us 7 calendar days' written notice. If You have made any payment to Us for any Services We have not yet provided, these sums will be refunded to You as soon as reasonably possible, and in any event within 14 calendar days of Our acceptance of Your cancellation. 

  • If PAC Planning have provided Services that You have not yet paid for, the sums due will be deducted from any refund due to You or, if no refund is due, We will invoice You for those sums and You will be required to make payment. 

  • You acknowledge that you do not obtain the right to a refund where you insist on our services being performed in a way that is against our advice. You will only be entitled to a refund at our sole discretion or where we determine that we are unable to perform the services for any reason.            



    Our Liability

     

  • PAC Planning will endeavour to provide professional services with reasonable care and skill. However, we will not be held responsible for any losses arising from the supply by you or others of incorrect or incomplete information, or a failure of you or others to supply any appropriate information.

  • Nothing in this Service Agreement seeks to exclude or limit Your legal rights as a consumer. For more details of Your legal rights, please refer to Your local Australian Competition and Consumer Commission (ACCC), Australian Consumer Law, or Trading Standards.
